Limited Warranty Contract                                     Home

 

Pamela Porter Crump (the Seller of the Shih Tzu) and ______________________ (the Buyer of the Shih Tzu) mutually agree to the terms and conditions of the following warranties of the Seller and obligations of the Buyer regarding the sale for the price of $_________ (which includes / excludes breeding rights) and delivery on the date of _______________ by the Seller to the Buyer of the Shih Tzu described as:

           

 

 

Warranties of the Seller

The Seller warrants for a period of two years from the date (stated above) of the delivery of the Shih Tzu to the Buyer that the Shih Tzu will not have any congenital defect that causes an uncorrectable life threatening condition as determined by a licensed veterinarian, whether or not the Shih Tzu dies.

The Seller warrants for a period of twenty days from the date (stated above) of the delivery of the Shih Tzu to the Buyer that the Shih Tzu will not die (or be diagnosed by a licensed veterinarian as terminally ill and die within twenty days of that diagnosis) due to any disease that could have been prevented by the Seller (whether or not congenital in nature).

If the Buyer purchases breeding rights, then the Seller warrants that at the time of delivery (as evidenced by the checkup at the first veterinarian visit by the buyer) (1) that the Shih Tzu has no inguinal hernia and (2) that (if the Shih Tzu is a male) it has (or will have by the age of 6 months) two descended testicles.

Obligations of the Buyer

The Buyer will have the Shih Tzu examined by a licensed veterinarian within three weeks of receiving the Shih Tzu.

The Buyer will notify the Seller of the results of any and all examinations that reveal any condition covered by the guarantees of the Seller by email to PamCrump@PamCrump.com or by phone (361) 877-0028 within 24 hours of the examination(s). 

The Buyer will follow the treatment (if any) prescribed by a licensed veterinarian. 

The Buyer will provide to the Seller a signed statement from a licensed veterinarian (within four days of first notifying the Seller of a condition covered by the guarantees of the Seller) certifying the diagnosis, the date of the diagnosis, the cause(s) and the date of death of the Shih Tzu (if deceased), and the history of examination and treatment by any veterinarian(s).

Failure of the Buyer

Failure of the Buyer to satisfy any of the obligations of the Buyer (as stated above) will relieve the Seller of any and all obligations to the Buyer under the terms of this contract.

Failure of the Seller

Failure of the Seller to satisfy any of the warranties of the Seller (as stated above) obligates the Seller to refund to the Buyer the price of the Shih Tzu (as stated above) within 30 days after the complete satisfaction by the Buyer of the obligations of the Buyer (as stated above) and the return of the Shih Tzu (if living) to the Seller by the Buyer.

General Conditions

The Buyer understands and agrees that all costs of medical diagnosis and treatment are the sole responsibility of the Buyer.

The limited warranties of the Seller described in this contract are made to the Buyer, and are not transferable to any other party without the express written consent of the Seller.

No other warranties or guarantees of any kind (expressed or implied) are made relating to the sale of the Shih Tzu.

The Seller agrees to the terms and conditions of this contract, as evidenced by signature below.

The Buyer agrees to the terms and conditions of this contract, as evidenced by signature below or (if unsigned) as evidenced by taking delivery of the Shih Tzu.

Return of Shih Tzu

The Seller will accept at any time the return of the Shih Tzu for any reason at all, but with no assurance of any refund to Buyer other than as stated above.

This contract is entered into by the Seller and the Buyer under the laws of the State of Texas.  If the contract is adjudicated, it will be adjudicated only in Nueces County, Texas.   If any specific element(s) of the contract is (are) determined by a court to be unlawful or invalid, that finding will not invalidate the remaining terms of the contract.
