Contract for Return of Shih Tzu

 

 

______________________ (the Buyer) will return to Pamela Crump (the Seller) the Shih Tzu (along with AKC registration papers) previously purchased by the Buyer from the Seller, and described as:

Both the Seller and the Buyer confirm the following mutual understanding:

 

The primary purpose of the return is for the welfare of the Shih Tzu, including finding it a good new owner.

 

The Seller will place the Shih Tzu with a new owner.

 

If the new owner pays more than $200.00 for the Shih Tzu, the Seller will refund to the Buyer the lesser of:

 

                a.  the sum of $_________ (which is the original purchase price, less $200.00), or

 

                b.  the amount in excess of $200.00 paid by the new owner.

 

That refund amount will be reduced by any cost incurred by the Seller to obtain the return of the puppy and by $3 per day for the number of days from the return to the placement with the new owner.

 

If the new owner pays $200.00 or less for the Shih Tzu, the Seller will refund nothing to the Buyer.

No assurance is given by the Seller to the Buyer as to any amount that may be refunded.

As evidence of the transaction with the new owner, the Seller will provide the Buyer with a copy of the Limited Warranty Contract signed by the new owner, which discloses the amount paid by the new owner.

If the Buyer later decides to take back the Shih Tzu and the Seller has not yet placed the Shih Tzu with a new owner, the Seller will return (with transportation at the Buyer's expense) the Shih Tzu (along with AKC registration papers) to the Buyer for a fee of $3 per day for the number of days beginning with the date (as shown above) that the Buyer returned the Shih Tzu to the Seller and ending with the date that the Seller returns the Shih Tzu to the Buyer.

 

This contract is entered into by the Seller and the Buyer under the laws of the State of Texas.  If the contract is adjudicated, it will be adjudicated only in Nueces County, Texas.   If any specific element(s) of the contract is (are) determined by a court to be unlawful or invalid, that finding will not invalidate the remaining terms of the contract.
